The Role and Function of the Attorney General
The Attorney General is the constitutional, statewide elected official who serves as the attorney for the State of Florida. The Attorney General is responsible for the enforcement of state consumer protection and antitrust laws as well as civil prosecution of criminal racketeering. In the area of criminal law, the Attorney General represents the State when those convicted appeal their convictions, including capital murder cases.
The office also conducts various programs to assist local law enforcement agencies and crime victims, while further aiding the pursuit of criminal activities not limited to a single area of the state -- including the rapidly expanding crime of identity theft -- through the Office of Statewide Prosecution.
The Attorney General is authorized to issue formal legal opinions at the request of various public officials on questions relating to the application of state law and defends the constitutionality of statutes duly enacted by the Legislature.
The Attorney General, along with the Chief Financial Officer and the Commissioner of Agriculture and Consumer Services, serves on the Florida Cabinet. As a member of the Cabinet, the Attorney General also serves as a trustee of public lands and as a member of the Clemency Board. The Attorney General serves as legal advisor to the Cabinet and represents the Governor, and Governor-directed state agencies, in litigation. Along with the Governor, this body serves as a board of directors for several state entities, including Law Enforcement, Revenue, Highway Safety and Motor Vehicles and Veterans Affairs.
